Adultery Stoning Law In Aceh

Yesterday, I was checking my BBC news feed and stumbled upon a news tittled “Aceh Passed Adultery Stoning Law” which apparently just happened (Monday, 15 September). The article said that one of the province parliement member Aceh, Bahrom Rasjid, said that Aceh regional legislature has passed the bill anonymously. The new bill will make adultery punishable by stoning to death for married individuals and up to 100 lashes for unmarried ones. The law will also impose sentences for rape, homosexuality, alcohol consumption, and gambling.

The governor, Irwandi Yusuf, which is a former member of GAM (Free Aceh Movement) tried to delay the imposing of the sharia law, but Rasjid says, “This law will be effective in 30 days with or without the approval of Aceh’s governor.” Aceh has already enforced Muslim dress codes and mandatory prayers. “This law is a preventive measure for Acehnese people so that they will avoid moral degradation,” said Moharriyadia, a spokesman of PKS (Prosperous Justice Party).

The law receive support from MUI ( Indonesian Council of Ulama), Indonesia’s top Islamic body. Ma’ruf Amin, the head of MUI welcomed the new hardline law. He said, “The Council supports sharia law in areas where it is allowed, like Aceh, which has special autonomy. It’s not a matter of good or bad. For Muslims, sharia law is the best and can be implemented anytime, anywhere. As long as there is agreement from everyone, there’s no problem.”

Then today I found again one news about human rights activists protest against the law. It seems that the Indonesian Human Rights Commussion has been alerted about the issue.   “The laws that have been approved in Aceh are cruel and degrading to humanity,” National Commission on Human Rights (Komnas HAM) head Ifdhal Kasim told AFP.They will protest the implementation of the law and try to ask the President to overrule the law.

The good news is that the new parliement that will be sworn in next month after the moderate local Aceh Party (ex GAM) won most of the provincial seats in the last election say that they will review the law immediately.

I found this news very disturbing. In my opinion this particular implementation of the law is more like a political strategy of people who are going to be out of the legislation position to gain more popularity for the sake of their future stake in their own political parties. This also brings another negative story for the majority of Indonesian moderate Muslim. I know most of my Muslim friends, if not all, will find this law stupid, irrational, badly enforced, and totally not suitable for Indonesia. I can already imagine that most of the people who will be stoned to death are women, just like the story in the Bible of Jesus time 2000 years ago (John 8:6-8)!

I am also surprised that until I am writing this article, none of the Indonesian news agencies put this story in their websites. I wonder if there is indeed a popular political scheme to put this under the carpet. I hope that this law will be canceled. I also believe that when people will have enough information about this, they able to think rationally and decide wisely that we don’t need this middle age law to enforced a certain ideology.

Kemaren ketika saya sedang melihat-lihat newsfeed BBC, saya melihat sebuah article berjudul “Aceh Passed Adultery Stoning Law” (Aceh mensahkan Hukum Razam atas perzinahan) yang kelihatannya baru saja terjadi (Senin, 15 September). Artikel ini mengatakan bahwa salah seorang anggota DPRD Aceh Bahrom Rasjid, mengatakan bahwa DPRD propinsi Aceh telah menyetujui pengesahan peraturan daerah tersebut. Peraturan ini akan menghukum orang yang melakukan perzinahan dengan melemparinya dengan batu sampai meninggal untuk mereka yang sudah menikah, dan 100 hukuman cambuk buat mereka yang belum menikah. Mereka juga mengatur hukuman berat untuk perkosaan, homoseksual, minum minuman beralkohol dan judi.

Gubernur Aceh, Irwandi Yusuf, seorang eks-GAM, berusaha menunda pemberlakuan hukum syariat ini. Tetapi Rasjid mengatakan, “Hukum ini akan berlaku dalam 30 hari dengan atau tanpa persetujuan gubernur Aceh.” Aceh sendiri sudah menetapkan peraturan mengenai swajib berpakaian Muslim dan wajib sholat 5 waktu. “Hukum ini adalah langkah pencegahan untuk rakyat Aceh sehingga moral mereka tidak terkikis,” ujar Moharriyadia, seorang juru bicara Partai Keadilan Sejahtera (PKS).

Peraturan ini juga menerima dukungan dari MUI. Ma’ruf Amin, seorang Ketua MUI, menyambut peraturan keras ini. Dia mengatakan, “MUI mendukung hukum syariat di daerah di mana dia diijinkan untuk berlaku, seperti di Aceh, yang memiliki otonomi khusus. Ini bukan masalah baik atau buruk.  Bagi umat Islam, hukum syariat adalah yang terbaik dan bisa diterapkan kapan saja di mana saja. selama ada persetujuan dari semuanya, maka tidak ada masalah.

Lalu hari ini saya juga melihat berita human rights activists protest against the law. Tampaknya Komnas HAM Indonesia sudah mengetahui kasus ini. “Peraturan yang disetujui di Aceh adalah kejam dan merendahkan martabat manusia,” kata anggota Komnas HAM Ifdhal Kasim ke AFP. Mereka akan memprotes pemberlakuan peraturan ini dan meminta Presiden untuk menolaknya.

Kabar baiknya adalah mayoritas anggota DPRD Aceh baru yang memenangi Pemilu yang lalu, yang akan dilantik bulan depan berasal dari kelompok eks GAM moderat mengatakan bahwa mereka akan membatalkan peraturan ini secepatnya.

Berita ini meresahkan saya. Menurut saya, pemberlakukan peraturan ini lebih merupakan strategi politis orang-orang yang sudah tidak memperoleh kursi di badan legislasi untuk memperoleh popularitas sebagai modal pemilu berikutnya bagi partainya. Hal ini juga akan membawa citra negatif bagi mayoritas kaum Islam moderat di Indonesia. Saya tahu kebanyakan teman Muslim saya, mungkin semuanya, akan mengganggap bahwa peraturan ini adalah bodoh, tidak rasional, dipaksakan untuk diterapkan, dan benar-benar tidak cocok untuk Indonesia. Saya sendiri sudah membayangkan bahwa perempuan akan menjadi korban utama hukum yang tidak adil ini, seperti cerita di Alkitab pada zaman Yesus 2000 tahun yang lalu (Yohanes 8:6-8)!

Saya juga heran bahwa sampai tulisan ini saya buat, belum ada kantor berita Indonesia yang mengangkat masalah ini. Saya curiga jika memang ada rancangan politis untuk menutup-nutupi kasus ini. Saya berharap bahwa hukum ini akan dibatalkan. Saya juga percaya jika orang mendapat informasi lebih, maka mereka akan berpikir lebih rasional dan memutuskan dengan bijak bahwa kita tidak lagi butuh peraturan dari abad pertengahan untuk memaksakan paham kelompok tertentu.
